MANDATORY NON-REFUNDABLE PAYMENT PORTION: 50% of contract total
How much is non-refundable? The reserving of a date and canceling causes MPVG to suffer loss. The “non-refundable reservation payment portion” is non-refundable and also covers time spent on many aspects of works prior to event that are impossible to calculate (including travel and time spent on consultations, scheduling, billing/accounting, contract drafting, phone calls, email communications, industry advice and timeline support provided, mailing/postage of paperwork, promotional free gifts, database file set-up, paper/ink costs for printing, bookkeeping, year end tax planning and filing, staff scheduling, invitation and participation in exclusive events where prizes are given, referral fees already paid out to others, etc.) The NON-REFUNDABLE PAYMENT PORTION also serves as liquidated damages of loss of business in event of client cancellation or non-payment, even if MVP is able to re-book the same date with a different client later. Client has been advised to obtain private event insurance, if available such as http://www.wedsafe.com. This fee is a non-refundable payment portion has been agreed upon as reasonable and acceptable. MPVG reserves the right to collect this amount, if necessary, if not paid by client plus legal costs.
CANCELLATION POLICIES:
GENERAL CANCELLATIONS Examples: Deciding to elope, illness or medical emergencies, hospitalizations, no longer getting married, changing wedding date due to pregnancy or other personal reason, changing mind on vendor selection, overall regret, venue renovations, venue out of business and not having alternative location planned, date postponement, ect): MPVG has reserved the date for your wedding. If client does not get married on planned wedding date, at planned venue, or any other alternate venue, client is in breach of contract. If client cancels the contract for any reason, MPVG keeps the non-refundable reservation payment on page 1, but refunds any other payments made. If client cancels before the non-refundable portion has been paid, that is due to MPVG immediately. If client reschedules their event, that constitutes a cancellation. MPVG, at its own discretion, may allow for a change of date subject to a $800 rescheduling fee. Client has been recommended to get private event insurance.
***MPVG reserves right to terminate contract at any time for any reason, refund monies paid, and be released of all obligations. This includes, but not limited toMPVG believing cooperative communication, professional respect, mutual understanding, or realistic expectations can not be reached with client prior to the wedding. Any services already rendered, however, such as engagement sessions, will be retained by MPV.
EXCEPTIONS FOR COVID-19, PANDEMICS, NATURAL DISASTERS, ANY FORM OF FORCED GOVERNMENT RESTRICTIONS, LOCALIZED OR STATEWIDE ORDERS, CIVIL UNREST, FIRE/FLOOD, ETC
Weddings that are completely banned and/or otherwise cannot take place at all for complete impossibility: (Examples: statewide ban of gatherings, state shutdowns or regulations, roads too flooded to pass, tornado, blizzard, state of emergency, stay-at-home orders due to weather)
If a complete ban of weddings occurs, or a scheduled wedding cannot physically occur AT ALL for reasons beyond the client’s control, client will be asked to reschedule without penalty or fee. Client shall choose a date that MVP offers as available. If client chooses a date not offered as available with MPVG, the wedding shall be deemed canceled and the non-refundable payment portion shall be forfeited. Again, client agrees to either rescheduling (no fee) or entering into a standard cancellation and losing the amount listed above. Client has been recommended to get private event insurance and plan for alternate wedding location in case their venue goes out of business.
VENUE REQUIREMENTS:
It is the client’s sole responsibility to research, understand, and gather all venue(s) requirements to ensure MPVG will be granted permission to be on venue(s) premises PRIOR to booking. If your venue requires signed forms from vendors, you need to provide this to MPVG for our approval before booking. This is crucial, as you are agreeing to a non-refundable payment portion. MPVG is not obligated to sign any additional contracts, waivers, policies, or agreements after today’s date with client or with their venue, this includes, but is not limited to, waivers of liability, hold harmless agreements, ect. MPVG is not required to increase their insurance coverages beyond what is currently covered. If venue(s) will not allow MPVG on premises, for any reason at all, MPVG keeps the non-refundable payment portion and will refund any balance thereafter as the date was reserved in good faith with you with understanding that authorization from venue(s) was previously granted to client.
MPVG agrees to provide venue(s) with a valid proof of standard business insurance policy of $1,000.000 general liability. For most venues this is enough. If venue(s) requests a higher $2,000,000 policy from MPVG, the cost to be charged to client is $550, if the change is even possible. Other rare circumstances: If venue desires to be named “additional insured” or “certificate holder” on our insurance, the cost to be autocharged to client is: $150. If venue desires an insurance “waiver of subrogation endorsement” from MPVG, the cost to be autocharged to client is: $250. If venue desires a clause for “primary and noncontributory endorsement” the cost to be autocharged to client is: $200. There are separate and individual charges for each venue demand, per venue. This will be automatically charged to the payment method on file.
CONTRACT:
At the time contract takes effect, Meyer Photo Video LLC (MPV) shall reserve the date above for client. Contracts cannot be downgraded after signing. Discounts/coupons cannot be applied to a contract signing. Extra time cannot be guaranteed as available. MPV preferred to be contacted by e-mail/direct mail for all concerns so there is a paper trail of all communication, however client can also call or text. Please anticipate standard business response times up to 72 business hours, and possibly longer, during peak wedding season. We have strongly recommended client to hire TWO videographers for a day as important as a wedding. To only hire one (lower cost), knowing unforeseeable circumstances can arise (such a car accidents, broken gear, emergencies, illness, injury/falls, camera malfunction) client assumes this risk and expects possible negatively affected coverage. MPVG will only take direction and engage in communication from the party named on contract, regardless of who is paying.
TIMELINE:
MPVG needs to properly anticipate hours needed. Itinerary paperwork will be sent to client approximately one month prior to event with requests for start/end times and locations. This must be completed within 2 weeks of the event so staff schedules can be properly arranged and staff can coordinate things such as transportation and child care. No changes can be guaranteed once this timeline is submitted. If client requests a timeline change after completing this paperwork, or within 2 weeks of event (and MPV is willing/able to accommodate) a $50 fee will be auto-charged to the payment method on file for time to coordinate new staff schedules. If the itinerary paperwork is not completed at all within 2 weeks of event, a $75 fee will be auto-charged to the payment method on file for late minute urgent coordination of staff schedules.
OVERAGES IN TIME:
If client requests any extra time the day of the wedding (and staff is willing to stay late), client will be auto charged $125 per every requested 15 minutes per professional ($500/hr). All photos/video will not be delivered until this extra bill is paid in full. If no payment method is on file, an invoice will be sent. (If client requests any extra time BEFORE the day of the wedding (and staff is available), the cost is $450/hr per staff member.) All overages may be charged directed to the payment method on file, if there is one. If a formal part of the wedding has run late/occurring during your end time (ie. ceremony, cake cutting, a speech, the bouquet toss, a blessing) , you allow MPVG, upon their discretion, to stay until that specific formality is over, at a maximum of 30 minutes ($350). You will be responsible for the overage fee, which will be charged to your payment method on file. It must be paid before any photo/video are delivered.
PARTY RIGHTS, FAILURE TO PERFORM, AND LIMIT OF LIABILITY
MPVG reserves the right to leave an event if they are being verbally harassed, threatened, abused, assaulted, or otherwise made fearful of their safety by client or client’s guests. Client will receive a warning, and if situation is not corrected, MPVG will leave and not be obligated to refund any monies. Situations affecting MPVG such as traffic jams, vehicle breakdown, flat tires, car accidents, illness, or personal emergencies, or other cause, even with the best intentions and precautions, are possible. If no photographer/videographer from MPVG can perform this agreement on this specific date, then MPVG shall reserve the right to refund all monies paid, but shall have NO further liability with respect to the agreement. If MPVG fails to perform for any reason, MPVG shall not be liable for any amount in excess of the “balance due” amount. Client agrees that MPVG is not responsible for any other damages, emotional or otherwise, regardless of fault. This limitation on liability shall also apply in the event that video materials are damaged in processing, lost through camera/memory card malfunction, stolen, or otherwise lost or damaged by MPVG. These instances are rare, but client is aware technology may fail. If MPVG staff is late, you will receive a refund appropriate to your contracted rate. For example, if your contract for photography is $2,000 for 8 hours, and your videographer is 30 minutes late, you will receive a refund of $125
TRAINEE DISCOUNTS (60 DAYS)
MPVG offers deep discounts for “trainee” packages. These cheaper packages, if selected by the couple, would be notated on the deliverables part of this contract. It simply means the photographer and/or videographer being sent may be someone who is in training, recently graduated or in school, a new hire, someone of lower skill set, or someone with just less wedding experience than standard staff. Expectations of reduced quality should be expected and should be booked at the client’s risk.
STATUE OF LIMITATIONS
Due to the understanding that MPVG does not store media or any client notes indefinitely, client agrees that there shall be a strict 60 day statute of limitations for the filing of any actions or lawsuits relating to contract. The 60 days begin from the time claimant knew or should have known of its claim, whichever is sooner. If any claim is brought after this time, the filing claimant is responsible for the opposing party’s court fees related to seeking dismissal for improper filing. MPVG shall not be liable for any amount in excess of the “balance due” amount on this contract. Client agrees that MPVG is not responsible for any other damages, emotional or otherwise, regardless of fault. Any legal fees accrued by client prosecution must be paid only by client. All legal claims must be brought only through the Ocean County New Jersey court system. If client litigates against MPVG and is not found to be the prevailing party, client agrees to reimburse MPVG all legal fees incurred, pay damages for any loss of business, and other damages, including time spent related to appearing in court.
PAYMENTS AND BALANCE OWED
Client has agreed to a set payment plan. Any unsuccessful, bounced charge, or late payment will incur a $50 fee.
If you need to change your payment method on file, there will be a $15 fee charged. If any payment is more than 30 days late, it is considered a breach of contract and MPVG has right to terminate this agreement, release the event date back to the public, retain the non-refundable “reservation payment” and have no obligation of services to client. MPVG is not responsible for any payment sent to the wrong VENMO account. Our official VENMO account is: @themeyerphotoandvideogroup
Client has requested a payment plan instead of paying in full. MPVG reserved their wedding day in good faith the payments would be made on time. Declined payments cause MPVG hardship through fees and time. In the event that two processed payments are returned, declined, or otherwise fail due to insufficient funds, or any other reason, MPVG reserves the right to cease processing future payments and require the entire remaining balance, including any applicable failed payment fees, to be paid in full within thirty 30) days of notification via check, Venmo, or cashier’s check. Failure to provide full payment within that specified timeframe will be deemed a breach of contract and the wedding date will be released and no services rendered. Client’s payments up to the non-refundable payment portion on page 1 will be kept by MPVG, but all other monies paid by client will be returned. Any chargebacks fees will be due immediately from the client.
If MPV staff is late, you will receive a refund appropriate to your contracted rate. For example, if your contract for videography is $2,000 for 8 hours, and videographer is 30 minutes late, you will receive a refund of $125.
If any payment is accidentally not charged by MPV to the client due to a billing error, it will be charged immediately upon discovery.
COPYRIGHT, PRIVACY, AND REVIEWS
MPVG shall own copyright to all video and photo MPVG and vendors may use photo/video for portfolios, samples, self-promotions, social media, online advertising, print, website, media, or to share with vendors without restriction. It is client’s responsibility to notify all of their event guests that video/photo will be taken. Client may also use photos and video in any way personal-use. MVP may share access to any video /photos taken and contents/details of this contract, and/or related emails/texts/messages/etc publicly in event MPVG finds it necessary— especially to defend their services on social media, to venues, media, and websites that allow online reviews and others. While MPVG encourages the fair use of online reviews for valid grievances, client agrees to refrain from any acts of defamation, libel, or slander (false or exaggerated claims) regarding MPVG. This includes encouraging others such as family/guests to post false reviews. Client agrees to reimburse all legal fees, pay damages for loss of business, damage to reputation, and other damages arising from prosecution time for false and/or exaggerated reviews. If any lawsuit occurs before photos/video are delivered, or if client threatens lawsuit, MPVG reserves the right to not deliver anything until court’s decision.
INCLEMENT AND EXTREME WEATHER
If inclement extreme weather such as blizzard appears to be possible and wedding is less than 7 days away, client will be offered opportunity to reschedule without penalty/fee. Client shall choose a date that MVP offers as available. If the client chooses a date not offered as available with MPVG, the wedding shall be deemed canceled and the non-refundable portion shall be forfeited.
MPVG reserves right to not shoot video/photos in the rain/snow.MPVG may refuse to shoot outdoors if lightning strikes are within 25 miles even if it is not yet raining, in which case all photography/video would need to take place inside. In cases of extreme weather that may threaten the lives and safety of it’s employees or contractors (tornado, hurricane, blizzard, extreme winds, flooding ect) MPVG reserves the right to not provide services at all and refund all monies paid. Even professional cameras may overheat or malfunction in temperatures exceeding the 90’s. Therefore we recommend having indoor ceremonies during heat waves or selecting a ceremony spot in the shade during a time period that is not peak heat. Portraits in heat waves should be limited outside. A camera that has overheated can take up to 30-45 minutes to cool down to operate again. Also, cameras may not operate in temperatures under 32 degrees. Not following these guidelines may result in missing or damaged footage and MVPG is not responsible. Client agrees to all services rendered inside when air quality reports are hazardous, exceeding level 100 by AirNow.Gov, for instances if there are nearby forest fires. No refunds would be given for staff refusing to provide services outdoors.
PERFORMANCE
MPVG is not required to participate in any meetings aside from service coordination via phone/email. MPVG is hired for only services paid for. MPVG is not a wedding planner or coordinating service and does not handle planning, timekeeping or overall day-of scheduling and organizing. MPVG may provide basic, general guidance for your wedding timeline such as how long portraits would take, however a request for a full itinerary creation, timing of your other vendors, transportation needs, etc, is outside our scope of service and would incur a fee, not to exceed $50. Estimated number of photos delivery is usually around 60-125 per hour depending on the events of the day but no specific amount is guaranteed.
Wedding are chaotic, uncontrolled live events; often involving alcohol. During ceremonies, photographer/videographer is limited to the areas allowed by officiant. This may cause obstructed views. MPVG is not responsible for shots that are missed or omitted because of staff being blocked by guests unwilling to move. In some cases, churches may not allow our staff in at all or may require MPVG to shut off cameras during certain sacred moments. Some venue may not allow tripods on floor and this will affect stability. MPVG is not responsible for guests cellphones being held and in the way of key subjects in photos/video. MPVG is obligated to follow the rules of the venues. MPVG may take periodic short breaks to get water, food, or use the restroom. MPVG is not responsible for venues or DJs initiating important moments like cake-cutting without MPVG staff in the room that may be in the restroom. MPVG may suggest locations,, but client has final decision making. Client accepts all risks and responsibilities of their own safety on locations including falls and other physical injury, damage to hair/wardrobe, animal bites/attacks, etc. MPVG is not responsible for any injuries inflicted upon any participating parties, to, from, or at the session locations. Client(s) accept all responsibility and liability for any hazards, injuries, or risks associated with the selected location(s) for session.
It is Client’s responsibility to ensure key individuals are on time, sober, and prepared to be photographed and videotaped. MPVG cannot be responsible for limited video due to bride, groom, bridal party, or guest’s lack of cooperation or time delays. MPVG will use discretion as to which moments to capture and retains all creative freedom. For photos most similar to our portfolio in terms of quality, volume, variety, posing, etc you have been recommended to allot at least 45 minutes of portraits time with the couple alone, 30 minutes for bridal party photos, 30 minutes for family photos, and 60 minutes of getting ready.
We strongly recommend having no other professional photographers/videographers at your event, including ones supplied by DJs or venues for their own marketing as this often leads to confusion, competing for “the best shot” and leads others getting in the way and causing missed shots, shaking footage, etc. When client allows additional outside professionals despite this warning, MPVG can not do the best job possible and client assumes risk. MPVG will not be responsible for any and all issues arising from other photo/videographers on the premises.
DELIVERY AND FILE DELETION
MPVG does not guarantee delivery of any specific video clip or photo. MPVG will use discretion as to which moments to capture and which to deliver to client and retains creative freedom. All creative aspects such as shooting and final editing style are at the discretion of MPVG. Client grants creative control to MPVG for all aspects of the production and post-production services for the event. MPVG uses discretion as to which moments to capture and deliver to client and retains creative freedom.
Audio quality from weddings cannot be guaranteed as these rely on the quality and consistency of the microphones /speakers provided by DJs, bands, churches, and venues. MPVG only can record the audio that a guest of the event would hear. As an example, if the microphone a client is provided by their venue to perform their vows fails to project any sound due to malfunction or low volume, the vows may not be audible on video. MPVG must be allowed appropriate time (approx. 15 minutes) at each location to set up tripods. Wedding are chaotic live events with often intoxicated guests- clients should have reasonable expectations that videos will not be perfect and will include some unavoidable things like sharp camera movements, shakiness, and blocking by guests. Client should warn officiant to stay silent and not speak/chatter/joke with groom/groomsmen during processional/recessional, as this will likely be heard in your final video.
Video will be delivered within 90 days electronically via link unless otherwise noted above. All videos are delivered based on MPVGS aesthetic without input or approval from the client. All video files are delivered as .mp4 files or .mov files. MPVG is not responsible for video not playing correctly on technology devices that do not play these types of files. Client must download video within 30 days of delivery. MPVG does not host online or keep video footage indefinitely. It’s client’s responsibility to watch and download within delivery window. Client must contact MPVG within 30 days of wedding video delivery if they have any trouble accessing , receiving, or viewing video so this can be remedied while the files are still accessible to MPVG. Replacement fees of video (if even possible to replace) after that point, begin at $200.
“Not liking” delivered video or photos is not grounds for refund. MPVG is simply hired to record parts of the day and make an edited video (or provide photos) based on MVP’s experience and esthetic. A refund is only issued when MPVG fails to appear, or does not deliver what is specifically contracted above. MPVG makes no guarantees in regard to quality because these are subjective and influenced by many factors (ie. weather, light, environment, client lack of cooperation, guests that block movement, etc.) MPVG cannot guarantee use of any particular songs in edited videos due to licensing restrictions. Songs used are at editor’s discretion.
MPVG will only deliver the length video that is purchased. For instance, if a contract promises a videographer for 8 hours but has a 60 minutes video as a deliverable, you will ONLY get a 60 minute video. Coverage time is only the videographer’s presence at the event. Videographers do not film every moment of the day, only enough footage to provide the deliverable. Because of this, entire ceremonies may not be filmed. Raw video footage is defined as unedited, original, short clips of video that are not color corrected or stabilized. Raw footage is normally between 30-45 minutes in length. Raw footage is not included unless purchased on the above contract and is never available for purchase if not on this contract specifically.
Client’s package includes an edited video. This contract does not include additional edits beyond what is delivered. Any video edit requests will incur an editing charge of at least $200 but no more than $600, if MVP wishes to accept the additional editing work based on their schedule/preference. There are NO exceptions to this policy. Each client is offered the option to purchase rounds of editing for a fee when booking, which was declined in this contract. Therefore, client received a reduced fee waiving any additional edits.
MPVG makes no guarantees in regard to quality of photographic images because these are subjective and influenced by many factors (ie. weather, light, environment, subject’s lack of cooperation, time restrictions, guests that block movement, etc.) This contract does not include any photo edits or “photoshopping” of any kind, such as blemish removal, weight changes, hair, rashes, bruises, de-aging, tattoo removal, etc. Any edit requests by client may be completed solely at MPVG’s discretion and at a rate of $20 per photo. Photos will be delivered approximately within 90 days in an online gallery via link unless otherwise noted above. All images are delivered as .jpeg files. MPVG does not sell or provide .raw photo files. Client must download gallery images within 30 of online delivery. MPVG does not keep photos indefinitely. Client must contact MPVG within 30 days of wedding if they have any any trouble accessing , receiving, or viewing photos so this can be remedied while the files are still accessible to MPVG. Replacement fees of photos (if even possible to replace) begin at $200.
OTHER ITEMS, PRINTS, AND WARRANTY
MPVG offers prints but each client is welcome to print their photos wherever they would like. Not all print labs are created equal. Client is aware the MPVG cannot be held responsible for printing issues (color, clarity, blurriness, etc) for photos printed elsewhere. MPVG is not responsible for the lifespan of physical store devices provided (DVD, flash drive or hard drive). For example, we cannot guarantee that a hard drive will still be functional 3 years after the wedding. A 30-day warranty is offered on physical storage devices. MPV offers prints but each client is welcome to print their photos wherever they would like. Not all print labs are created equal. Backdrops are only used indoors. We have the right to stop the photobooth if guests (many of which may be under the influence of alcohol) are causing damage or being reckless. You will not receive a refund if this happens. You are responsible for any damage to photobooth, backdrop, or props during your event. MPVG is in no way responsible for any accidental injury in the booth. Client agrees that in the unforeseen event of a total loss of services the client would never be eligible to more than a total refund of the contracted amount. Client agrees that if any contracted digital photos or scrapbook are lost, client would be eligible a refund of $30.
LOCATIONS, PERMITS, PETS, AND SAFETY
Client is solely responsible for researching if their desired locations require permits and acquiring all permits necessary and paying any and all permit costs. MPVG will not perform services in any area that requires a permit, when one has not been obtained by the client. If client requests MVPG to secure the permit at a location due to that location requiring the vendor to facilitate, the cost to be autocharged to client would be ($100 fee + the cost of the actual permit) MPVG does not travel in limos, boats, trolleys, or other methods of transportation taken by client. MPVG does not travel outside of NJ. As a general rule, MPVG needs 15-25 minutes of breakdown/set up time at each area. Even more if the area is high-traffic along the shore during summer or holidays when parking is not readily available. Not allowing sufficient time in your timeline between different event happenings may cause missed footage/images or diminished quality. For instance, even if you are getting ready at home and the ceremony site is only one mile away, your videographer will need at least 15-25 minutes to get to the site and prepare. If your venue does not have available free parking, MPVG will make every effort to find free street parking the day of your event. In cases where free parking is not readily available, or continuing to seek free parking will possibly affect/delay your wedding timeline, MPVG may use valet parking or utilize a for-fee parking lot. In these cases, you agree to have your payment method on file charged for the parking fee, not to exceed a total of $50 per staff member.
If we are visiting your house for photos or video, all pets must have a valid, active rabies shot. Pets must be separated in another area away from our staff and gear. Even the calmest pets may behave unexpectedly with noise, numerous people, shouting, and flashing lights. You are responsible for any and all injury and/or damages caused by pets. MPVG reserves the right to leave any home staff feels unsafe in or if pets are not separated–– no refunds will be given for that time missed.
DRONE
Drone coverage is never guaranteed and based on many variables; township and state regulations, park rules, airspace notices, weather forecasts including anticipated wind speed and gusts even if the forecast is a week out, venue approval, overall evaluation of the set-up of area to ensure flight path would be safe for guests/ bystanders. You agree that MPVG has sole discretion whether to fly drone or not based on their expertise. If drone service is canceled, you will receive a refund for it.
